The Catchphrase That Expired: Why “First On The Dial” Belongs To Yesterday

When party primaries become instruments for imposing the preferences of powerful individuals, the credibility of the entire electoral process is weakened. The APC must therefore take responsibility for ensuring that its nomination procedures are transparent, consistent and compliant with the law
By Adekunle Alaye, PhD.
In a democracy, political ambition is legitimate, but it is never absolute. The desire to occupy public office, irrespective of one’s political standing or previous achievements, must always be subjected to the supremacy of the Constitution and the rule of law.
The recent Federal High Court judgment concerning the All Progressives Congress (APC) senatorial ticket for Imo West has once again brought this fundamental principle into sharp focus. The ruling, which declared former Imo State Governor Rochas Okorocha the party’s candidate for the 2027 senatorial election, dealt a significant blow to the ambition of the incumbent governor, Hope Uzodimma.
The judgment has generated political excitement, legal controversy and renewed debate about the relationship between political power and constitutional accountability.
Yet, beyond the personalities involved, this dispute raises a question that goes to the heart of Nigerian democracy: Can political influence, executive authority and personal ambition override the constitutional processes through which public office must be attained?
The answer, in principle, is no.
However, the significance of this case lies not merely in who has won or lost the immediate political battle, but in what the dispute reveals about the strength of democratic institutions, the responsibilities of political parties and the importance of judicial independence.
The Dispute: Two Political Titans, One Senatorial Ambition
The political rivalry between Rochas Okorocha and Hope Uzodimma is not new. Both men have occupied prominent positions in Imo State politics, and their competing interests have shaped the state’s political landscape for years.
Okorocha, a former governor and former senator representing Imo West, sought to return to the Senate through the APC’s 2026 senatorial primary.
Uzodimma, who is serving his second term as governor, also sought the party’s ticket for the same senatorial district ahead of the 2027 general elections.
The APC declared Uzodimma the winner of the primary conducted on May 18, 2026. Okorocha, however, challenged the outcome, arguing that the result did not reflect the actual votes cast and that the governor’s nomination was unlawful.
Political ambition is a legitimate feature of democratic competition. It is neither unlawful nor inherently objectionable for a sitting governor, a former governor or any qualified citizen to aspire to higher public office
On October 29, 2026, the Federal High Court in Abuja, presided over by Justice Obiora Egwuatu, ruled in Okorocha’s favour. The court held that the evidence before it established that Okorocha won the primary and ordered the APC to submit his name to the Independent National Electoral Commission (INEC) as its candidate.
The judgment also restrained Uzodimma from presenting himself as the party’s senatorial candidate.
The APC’s Imo State chapter rejected the ruling, raising concerns about constitutional timelines, judicial precedents and the evaluation of evidence. Uzodimma’s camp subsequently indicated its intention to challenge the decision at the Court of Appeal.
These developments make it important to distinguish between the judgment delivered by the Federal High Court and the final resolution of the dispute, which may depend on further judicial proceedings.
Nevertheless, the ruling has placed the constitutional and legal dimensions of political ambition at the centre of public discussion.
Political Ambition Is Legitimate, but Constitutional Compliance Is Mandatory
One of the most important questions raised by the dispute concerns the ambition of a sitting governor to become a senator before the expiration of his gubernatorial tenure.
Uzodimma’s second term is expected to end in January 2028, while the next National Assembly is scheduled to commence in June 2027.
This creates a potential overlap between his tenure as governor and the commencement of the Senate’s activities.
Section 183 of the 1999 Constitution provides that a governor shall not, during the period in which he holds office, occupy another executive office or engage in paid employment in any capacity.
The constitutional question is therefore whether the governor can lawfully pursue a senatorial ambition while remaining in office and, if elected, assume the position of senator before his tenure as governor expires.
It is important, however, not to confuse the constitutional eligibility to contest an election with the legality of holding two public offices simultaneously.
The distinction matters.
A political officeholder may possess the constitutional right to contest another election, but that right does not automatically confer permission to occupy two incompatible offices at the same time.
Consequently, the issue must be examined through the relevant constitutional provisions, electoral legislation and judicial interpretation rather than through political sentiment.
The Constitution is not an obstacle to legitimate ambition. It is the framework that makes such ambition lawful.
The Rule of Law: A Check Against Political Power
The central significance of the Imo senatorial dispute is the reminder that no individual, irrespective of political influence or public office, is above the law.
The rule of law demands that public officials exercise power within established legal boundaries. It also requires that political parties conduct their internal affairs in accordance with the Constitution, electoral legislation and their own validly established rules.
A political party’s declaration of a candidate cannot, by itself, extinguish the rights of another aspirant who believes that the nomination process was unlawfully conducted.
Similarly, the power of a governor cannot be used to transform an unlawful nomination into a lawful one.
Where credible evidence establishes that a primary election was manipulated, improperly conducted or inaccurately reported, the courts must be able to examine the matter without fear or favour.
This is essential to the credibility of Nigeria’s electoral system.
The judgment, if upheld on appeal, would demonstrate that political influence cannot substitute for compliance with electoral rules and that the courts remain an avenue through which aggrieved aspirants can seek redress.
However, the rule of law also demands that the judiciary itself be held to the highest standards of fairness, consistency and constitutional interpretation.
A court judgment does not become infallible simply because it favours one political actor over another.
Its legitimacy depends on the soundness of its reasoning, the quality of the evidence considered and its conformity with established law.
The Constitutional Strength of the Judgment and the Need for Judicial Scrutiny
The Federal High Court’s decision has been celebrated by Okorocha’s supporters as a victory for democracy and constitutional accountability.
There is a strong democratic argument behind that position.
If the evidence before the court established that Okorocha won the primary, then recognising him as the lawful winner would reinforce the principle that electoral outcomes must reflect the will of eligible voters or party members, as the case may be.
It would also send a clear message to political parties that internal elections cannot be treated as private arrangements in which the interests of powerful individuals automatically prevail.
Nevertheless, a balanced assessment requires serious consideration of the objections raised by the APC.
The party has questioned whether the suit was instituted within the constitutionally prescribed time for pre-election disputes. It has also raised concerns about the application of judicial precedents and the court’s evaluation of the evidence.
These are not insignificant issues.
Section 285(9) of the Constitution establishes a 14-day period for instituting pre-election matters within its scope. Whether that provision applies to the particular claims brought by Okorocha, and whether the suit was filed within the applicable period, are questions that require careful judicial determination.
The fact that a court has delivered judgment does not eliminate the right of an aggrieved party to challenge the decision through the appellate process.
Indeed, the Court of Appeal exists precisely to ensure that judicial decisions are subjected to further scrutiny where legitimate questions arise concerning the law or the evidence.
A genuine commitment to the rule of law therefore requires two principles to operate together: respect for judicial decisions and respect for the right to appeal against them.
Neither principle should be selectively invoked according to political convenience.
Democracy Must Be More Than the Ambition of Political Elites
The Imo senatorial dispute also exposes a broader weakness in Nigeria’s democratic culture: the tendency to reduce elections and political offices to the personal ambitions of influential individuals.
The Senate is a constitutionally established institution whose primary responsibility is to represent the interests of the people and participate in national lawmaking.
It is not a reward for political loyalty, a retirement destination for former governors or an extension of executive power.
Likewise, the governorship of a state is not merely a stepping stone to another political office.
When political leaders pursue multiple offices without sufficient regard for institutional responsibilities, the public interest risks becoming secondary to personal ambition.
The question should therefore extend beyond whether Uzodimma or Okorocha will secure the APC ticket.
What should matter most is whether the eventual candidate possesses the competence, integrity and commitment required to represent the people of Imo West.
The people of Imo West deserve a political process in which their interests are not overshadowed by elite rivalries.
They deserve transparent primaries, credible electoral institutions and representatives whose loyalty is directed towards public service rather than the consolidation of personal power.
The Responsibility of Political Parties
The dispute also raises important questions about the internal democracy of political parties.
Political parties are essential institutions in a democratic system. They provide the platform through which citizens organise, develop political ideas and nominate candidates for public office.
When party primaries become instruments for imposing the preferences of powerful individuals, the credibility of the entire electoral process is weakened.
The APC must therefore take responsibility for ensuring that its nomination procedures are transparent, consistent and compliant with the law.
Where conflicting claims arise concerning the outcome of a primary, the party should be able to produce clear and verifiable records demonstrating how its candidate emerged.
The Independent National Electoral Commission also has a responsibility to act within its statutory mandate and ensure that the nomination information it receives is consistent with the applicable electoral framework.
Ultimately, political parties must understand that internal democracy is not merely a slogan used during election campaigns. It is a constitutional and democratic obligation that must be reflected in their conduct.
Beyond the Courtroom: What This Means for Nigeria’s Democracy
The Imo senatorial dispute comes at a time when Nigerians are preparing for the 2027 general elections.
Its implications therefore extend beyond Imo West.
First, it reinforces the importance of credible party primaries. Political parties must recognise that the nomination process is not immune from judicial scrutiny.
Second, it demonstrates the importance of an independent judiciary. Courts must remain capable of examining disputes involving powerful political figures without being influenced by political pressure.
Third, it highlights the need for political leaders to respect constitutional limitations. Public office is a responsibility governed by law, not a personal entitlement.
Finally, it reminds citizens that democracy is strengthened when political disputes are resolved through lawful institutions rather than through intimidation, violence or the abuse of public authority.
However, the public must also resist the temptation to interpret every court judgment as a victory for one political camp and a defeat for another.
A judgment should be evaluated according to its legal merits, not merely according to the identity of the beneficiary.
The true triumph of democracy occurs when the law is applied consistently, irrespective of whether its outcome favours a political ally or opponent.
Conclusion: The Constitution Must Remain Greater Than Political Ambition
The Imo senatorial dispute presents Nigeria with an important democratic lesson.
Political ambition is a legitimate feature of democratic competition. It is neither unlawful nor inherently objectionable for a sitting governor, a former governor or any qualified citizen to aspire to higher public office.
But ambition must operate within the boundaries established by the Constitution.
The Federal High Court’s judgment in favour of Rochas Okorocha has brought this principle into sharp focus. It has challenged the assumption that political influence and executive authority can determine the outcome of an electoral process without regard to the law.
Yet the judgment must also withstand the scrutiny of the appellate courts, and its ultimate significance will depend on whether it is sustained, modified or overturned through lawful judicial proceedings.
That is precisely how constitutional democracy should function.
The rule of law does not require the courts to favour one political personality over another. It requires them to ensure that the same legal standards apply to everyone.
For Nigeria, the most important outcome of this dispute should not be the political triumph of Rochas Okorocha or the defeat of Hope Uzodimma.
It should be the reaffirmation of a fundamental democratic principle: No political ambition is greater than the Constitution, and no public office is more powerful than the law that establishes it.
When political ambition meets constitutional reality, democracy is strengthened not by the humiliation of one political actor, but by the preservation of institutions that protect the rights of all citizens.
That is the real meaning of the triumph of the rule of law.
