Justice James Kolawole Omotosho of the Federal High Court in Abuja has voided the removal of Phillip Shuaibu as the Deputy Governor of Edo State.
In delivering the judgment on Wednesday in the suit challenging the impeachment of Shuiabu by the state lawmakers, Justice Omotosho ordered that he be reinstated to office, saying the Edo State House of Assembly did not follow due process to sack him.
Justice Omotosho also voided the appointment of the new Deputy Governor who replaced Shaibu.
The court held that the grounds on which the House of Assembly relied on to impeach Shuiabu was untenable and unsustainable in law and did not constitute gross misconduct.
The judge, therefore, directed the Inspector General of Police to provide him with needed security to enable him resume office and perform the functions of the office until the end of his tenure.
